What is Therapeutic Use Exemptions, TUE ?

There may be situations where an athlete has an illness or medical condition that requires them to use a prohibited substance or method. A Therapeutic Use Exemption (TUE) permits an athlete to use an otherwise prohibited substance or method, for therapeutic purposes, whilst continuing to compete in their chosen sport.

What is a Therapeutic Use Exemption (TUE)?
A Therapeutic Use Exemption (TUE) is an official approval that allows an athlete to use a substance or method that is otherwise prohibited, for legitimate medical reasons, provided that the criteria set out in the International Standard for Therapeutic Use Exemptions (ISTUE) are satisfied.
When is a TUE required?
A TUE is required when an athlete needs to use a prohibited substance or method for medical treatment. In most cases, the TUE must be approved before the substance or method is used, except in emergency or exceptional circumstances permitted under the applicable rules.
Who must apply for a TUE?
Any athlete who is subject to anti-doping rules and requires the use of a prohibited substance or method for medical reasons must apply for a TUE in accordance with the applicable regulations.
Where should a TUE application be submitted?
A TUE application must be submitted to the appropriate anti-doping authority, depending on the athlete’s level and competition status. This may include the Anti-Doping Agency of Malaysia (ADAMAS), the relevant International Federation, or a Major Event Organization, in accordance with the ISTUE.
What are the criteria for granting a TUE?
A TUE may only be granted if all of the following criteria are met: (1) the athlete would experience a significant impairment to health if the treatment were withheld; (2) the use of the prohibited substance or method would not produce additional performance enhancement beyond a return to normal health; (3) there is no reasonable permitted alternative treatment; and (4) the necessity for use is not the result of prior non-therapeutic use of a prohibited substance or method.
Who decides whether a TUE is approved?
TUE applications are evaluated by an independent Therapeutic Use Exemption Committee (TUEC), which assesses the medical documentation and determines whether the ISTUE criteria are fulfilled.
How long is a TUE valid?
The validity period of a TUE depends on the athlete’s medical condition and prescribed treatment. The approval will specify the duration of validity and any conditions that must be complied with.
What happens if an athlete uses a prohibited substance without a valid TUE?
The use of a prohibited substance or method without a valid TUE may constitute an Anti-Doping Rule Violation and may result in sanctions in accordance with the World Anti-Doping Code.
Where can athletes obtain guidance on TUE applications?
Athletes are strongly encouraged to contact ADAMAS for guidance on TUE requirements, application procedures, and supporting medical documentation before using any medication or treatment that may involve a prohibited substance or method.
4 Conditions Must Be Fulfilled For TUE To Be Granted
It is a necessary treatment for a diagnosed medical condition

The treatment cannot improve performance other than returning the athlete to a normal state of health

No reasonable alternative treatment is allowed

The requirement to use cannot be due to the previous use of prohibited substances or methods without a valid exception
